The firm recognises that the traditional divorce/ negotiation methods, often culminating in court appearances and lengthy correspondence, can be stressful.
Negotiations in relation to children and the division of assets can lead to animosity. When a relationship break-up also means the end of a business partnership there is even more at stake.
That is why the Inverness-based practice is committed to encouraging clients to consider using collaborative family law as an alternative to the traditional methods of resolving family disputes.
This process enables a couple to deal with the practicalities of separation in a more amicable way.
The collaboration process allows the spouses to sit down together with two trained collaborative solicitors assisting with negotiations.
The process also allows for other corroboratively trained professionals to be involved in the process should the need arise. This allows the interdisciplinary skills of the professionals to be fully utilised in a cost-effective way.
The parties, along with their solicitors, must enter in to a contract known as a Family Law Agreement. This document is unique in so far as it requires both solicitors to sign the agreement along with clients, committing themselves to work in the spirit of the document.
The requirement of transparency removes the fear and suspicion associated with traditional approaches.
The clients continue to be represented by their own solicitor. The core provision of the agreement is the party’s commitment that they will not use the threat of court in the negotiation. Should the collaboration fail, neither party’s solicitor can represent them in future court proceedings. They can, however, instruct an alternative firm.
Collaboration enables parties in dispute to take more control of the particular circumstances around their separation. Clearly there has to be a spirit of co-operation and a genuine willingness to achieve an outcome acceptable to both parties.
